PRIVACY POLICY — Mercedes-Benz of Oxnard

Effective Date: September 23, 2026
Last Updated: September 23, 2026

This Privacy Policy governs the collection, use, and disclosure of information by Mercedes-Benz of Oxnard (“we,” “us,” “our”), a member of the Grieco Automotive Group, across our website at www.mbofoxnard.com, mobile applications, chat platforms, text messaging programs, phone systems, showroom kiosks, and any digital retailing tools we operate, including AI-powered chatbots, virtual assistants, and automated lead-management systems (collectively, the “Platform”).

By accessing or using the Platform, you consent to the data practices described in this Policy, including the use of artificial intelligence to collect, analyze, score, and act on your information as described in Section 3. If you do not agree, do not use the Platform.

1. INFORMATION WE COLLECT

We collect information aggressively and from every available touchpoint, including information you provide directly, information collected automatically, and information obtained from third parties.

1.1 Information You Provide

  • Identity and contact data: name, address, email, phone numbers, date of birth, driver’s license number.
  • Vehicle interest data: vehicles viewed, configured, compared, or inquired about; trade-in details (VIN, mileage, condition, photos); desired payment terms; down payment information.
  • Financial data: income range, employment information, residence history, Social Security number or partial identifiers submitted through credit pre-qualification or finance application tools.
  • Communications content: the full text, audio, and metadata of every chat conversation, text message, email, form submission, and recorded phone call with us — including conversations with our AI assistants.
  • Documents and media: photos or scans of IDs, pay stubs, insurance cards, or other documents you upload.

1.2 Information Collected Automatically

  • Behavioral and browsing data: pages viewed, vehicles clicked, time on page, scroll depth, search queries, filters applied, inventory viewed, pricing tools used, and abandonment events (e.g., started but did not submit a form).
  • Device and technical data: IP address, device identifiers, browser type, operating system, referral URLs, and approximate and precise geolocation.
  • Cookies, pixels, and tracking technologies: we and our partners deploy cookies, web beacons, pixels, session-replay tools, and device fingerprinting to track activity across sessions and devices. See Section 6.

1.3 Information From Third Parties

  • Lead aggregators, OEM data feeds, credit bureaus, marketing data providers, social platforms, and analytics vendors. We combine third-party data with data we collect directly to build a unified customer profile.

2. HOW WE USE YOUR INFORMATION

We use collected information for any lawful business purpose, including but not limited to:

  • Responding to inquiries and delivering requested quotes, valuations, and offers.
  • Operating, training, and improving artificial intelligence systems (see Section 3).
  • Lead scoring, prioritization, and routing to sales staff.
  • Personalizing vehicle recommendations, pricing, offers, and marketing.
  • Processing credit pre-qualifications, finance applications, and trade valuations.
  • Fraud prevention, identity verification, and legal compliance.
  • Analytics, market research, and business development.
  • Marketing and advertising, including retargeting across the web, email, SMS, and phone.

3. ARTIFICIAL INTELLIGENCE — PLEASE READ CAREFULLY

AI is central to how we operate. This section describes practices that go materially beyond a conventional dealership privacy policy.

3.1 AI Collection and Monitoring

  • Every interaction with our AI assistants, chatbots, and automated phone or text systems is logged, transcribed, analyzed, and retained. This includes questions you ask, documents you upload, and any personal information you volunteer in conversation — even in casual or hypothetical phrasing.
  • Our AI systems continuously analyze your browsing behavior, chat content, voice tone (where recorded), response latency, and engagement patterns to infer intent, urgency, price sensitivity, and likelihood to purchase.

3.2 AI Decision-Making

We use AI and automated systems to:

  • Score and rank leads, determining how quickly and by whom you are contacted.
  • Generate trade-in valuations and payment estimates presented to you.
  • Personalize pricing, offers, and inventory shown to you — two visitors may see different offers for the same vehicle.
  • Pre-screen credit and finance eligibility before a human ever reviews your file.
  • Draft and send marketing communications on our behalf.
  • Flag conversations for compliance, fraud, or escalation review.

You acknowledge that AI-driven outputs may be shown to you or acted upon without prior human review, and that AI systems can make mistakes. We do not guarantee the accuracy of any AI-generated valuation, estimate, pre-qualification result, or recommendation.

3.3 AI Training

  • We may use de-identified or aggregated conversation data, behavioral data, and interaction logs to train, fine-tune, and evaluate our AI models, including models operated by our vendors.
  • Where we determine data to be de-identified under applicable law, it is no longer treated as personal information and may be used for any purpose, including training models that serve other customers.

3.4 Consent to AI Processing

  • By using the Platform, you expressly consent to AI-based collection, analysis, scoring, and decision-making described in this section. AI processing of inquiries, chats, and lead data is a core function of the Platform and cannot be opted out of while using our digital services. If you do not want your information processed by AI systems, your option is to transact with us in person and decline digital communications.
  • Where automated decision-making produces legal or similarly significant effects (e.g., credit determinations), you may have rights under applicable law as described in Section 8; exercising those rights does not stop AI processing of your data for other purposes described here.

4. HOW WE SHARE YOUR INFORMATION

We share information broadly to operate our business. Categories of recipients include:

  • Service providers and vendors: our website platform provider (Dealer Inspire), our CRM provider (Elead), chat platform operators, AI and machine-learning vendors, analytics firms, marketing agencies, text-messaging providers, and call-tracking companies. Our AI vendors may process your conversation content on infrastructure we do not control.
  • Mercedes-Benz USA and Mercedes-Benz Financial Services, as required by our dealer agreements and for warranty, recall, certification, and marketing programs.
  • Advertising and data partners: we may share identifiers, behavioral data, and inferred interests with ad networks, social platforms, and data brokers for targeted advertising. Under California law this may constitute a “sale” or “sharing” of personal information — see Section 8 for opt-out rights.
  • Affiliated dealerships and business partners within our dealer group.
  • Legal and compliance: law enforcement, regulators, courts, and our attorneys when we believe disclosure is necessary to comply with law, protect our rights, or prevent fraud.
  • Business transfers: in connection with a merger, acquisition, or sale of assets, your information transfers with the business.

We do not sell your Social Security number or driver’s license number to data brokers.

5. DATA RETENTION

We retain personal information for as long as we have a business need — including marketing, analytics, AI training, dispute resolution, and legal compliance — which in practice means:

  • Lead and inquiry records: retained for a minimum of 7 years.
  • Chat transcripts, call recordings, and AI interaction logs: retained for a minimum of 3 years.
  • Marketing consents and behavioral profiles: retained until you opt out and any legally required retention period expires.
  • De-identified and aggregated data: retained indefinitely and used for AI training without limitation.

Even after you request deletion (Section 8), we retain information we are legally required or permitted to keep, including records needed to defend legal claims, comply with record-keeping laws, and data that has been de-identified.

6. COOKIES AND TRACKING TECHNOLOGIES

We use first- and third-party cookies, pixels, SDKs, session-replay software, and device fingerprinting to recognize you across visits and devices, measure campaign performance, and feed our AI personalization systems. Disabling cookies may break core Platform functions, including chat, inventory tools, and digital retailing. Our “Do Not Track” response: we do not honor browser DNT signals; use the opt-out mechanisms in Section 8 instead.

7. TEXT MESSAGING, CALLS, AND MARKETING COMMUNICATIONS

By providing your phone number, you expressly consent to receive marketing and non-marketing calls and text messages from us and our service providers, including by autodialer, prerecorded voice, and AI-generated voice or text, at any number you provide — even if it is on a do-not-call list. Message and data rates may apply. Consent is not a condition of purchase. To opt out of marketing texts, reply STOP; to opt out of marketing calls, tell any representative or contact us below. Transactional and AI-chat follow-ups related to an active inquiry are not marketing messages and may continue.

8. YOUR PRIVACY RIGHTS (INCLUDING CALIFORNIA RESIDENTS)

Depending on your state of residence (including under the California Consumer Privacy Act as amended by the CPRA, and similar laws in other states), you may have the right to:

  • Know what personal information we collect, use, disclose, and sell/share.
  • Delete personal information, subject to the retention exceptions in Section 5.
  • Correct inaccurate personal information.
  • Opt out of the “sale” or “sharing” of personal information for cross-context behavioral advertising.
  • Limit the use of sensitive personal information.
  • Non-discrimination for exercising these rights.

How to exercise: submit a request via [email protected] or through the privacy request form on our website, or call us at (805) 665-3011. We will verify your identity before processing requests and may deny requests we cannot verify, that are manifestly unfounded, or that conflict with our legal retention obligations. Authorized agents must provide written authorization.

Important limits on opt-outs: opting out of sale/sharing stops disclosures to advertising partners going forward. It does not stop: (a) AI processing of your data within our own systems and by our service providers; (b) sharing with the OEM or within our dealer group; (c) transactional communications about an active inquiry; or (d) our retention and use of de-identified data.

We do not use or disclose sensitive personal information (SSN, precise geolocation, etc.) for purposes that trigger the CCPA right to limit beyond what is necessary to perform requested services.

9. SECURITY

We use administrative, technical, and physical safeguards designed to protect personal information, including encryption in transit and at rest, access controls, and vendor security reviews. No system is impenetrable. We are not liable for unauthorized access resulting from factors outside our reasonable control, and you transmit information to the Platform at your own risk.

10. CHILDREN

The Platform is not directed to children under 16, and we do not knowingly collect personal information from children under 16. AI chat tools may inadvertently receive such information if volunteered; if you believe a child has provided information, contact us and we will delete it.

11. THIRD-PARTY SITES AND LINKS

Our Platform may link to manufacturer sites, lender portals, review platforms, and social media. Their privacy practices are their own; this Policy does not cover them.

12. CHANGES TO THIS POLICY

We may update this Policy at any time, including to expand AI uses or data-sharing practices. Material changes will be posted with a revised effective date. Your continued use of the Platform after changes are posted constitutes acceptance of the updated Policy. We will not separately notify you of every change — check this page periodically.
